Phelps County Man Sentenced for Possession with Intent to Distribute Methamphetamine
A Phelps County man was sentenced in federal court today for possessing 50 grams or more of methamphetamine.
The United States Attorney Jan Sharp announced that 32-year-old David James Burke, of Funk, Nebraska, was sentenced today to 92 months in prison by Senior United States District Judge Joseph F. Bataillon.
He was sentenced for possession with intent to distribute 50 grams or more of methamphetamine. Upon his release from prison, he will serve four years of supervised release and will also forfeit $6,480.00.
On October 23, 2017, the Nebraska State Patrol obtained a search warrant for Burke’s residence in Funk, Nebraska. During the search at Burke's residence, law enforcement officers found a pill bottle containing 54.42 grams of methamphetamine and $6,480. Law enforcement also seized a Taurus 357 magnum revolver from the armrest of the couch in the living room. Burke’s sentence was enhanced for possessing the firearm.
This case was investigated by the Nebraska State Patrol.
