Oglala Sioux Tribal Attorney General outlines changes to pot ordinance

The Oglala Sioux Tribal Attorney General’s Office says it will no longer be charging the crime of possession of marijuana for individuals over the age of 21 having less than an ounce of marijuana 1/8 ounce of concentrated THC oil.

The Oglala Sioux Tribal Attorney General’s Office says it will no longer be charging the crime of possession of marijuana for individuals over the age of 21 having less than an ounce of marijuana 1/8 ounce of concentrated THC oil.

Smoking marijuana in public places remains illegal; with a car operating on public roadways considered a public place under the tribe’s pot ordinance.

It’s also still illegal for anyone under the age of 21 to possess any quantity of marijuana with giving or selling marijuana to a minor illegal and punishable by up to 6 months in jail and a $500 fine.

Individuals between the ages of 18 and 21, who possess a medical marijuana card issued by the Marijuana Commission can possess an appropriate amount of the drug. 

Driving under the influence of marijuana remains illegal as transporting more than an ounce on or off the Pine Ridge Reservation except for licensed transporters. 

Prior marijuana possession convictions as being set aside, but convictions for distribution stand.
