BEATRICE – A 22-year-old Omaha woman who failed to complete the Southeast Nebraska Drug Court program, will serve a one-year prison term.
Destiny Burr’s sentencing was followed by a courtroom outburst from her mother, who the judge ordered to be taken into custody. Burr was convicted of attempted conspiracy to distribute drugs.

Her attorney, Gage County Public Defender Lee Timan said his client’s involvement was minimal, compared to other family members involved in the case.
"Certainly, Ms. Burr was accused of playing a small part in this grand scheme of distributing drugs throughout the community, but I do not believe...I haven't seen all the police reports and history of the case, but from what I see as far as the factual history, I don't believe anyone never indicated that she was personally delivering any drugs to anyone or that she was any high level organizer, distributor. If anything, it sounds like her involvement was perhaps driving around an uncle while he just did surveillance on law enforcement. Whether she knew was he was doing, or not, is certainly up for debate"


Timan said Burr had no prior record. He sought a jail term, rather than state prison…along with a term of post-release supervision. As the judge was speaking to Burr, he warned persons in the back of the courtroom not to speak.


"I think you know more what was going on with the methamphetamine trade amongst your family members, than you let on. You are looking at....if anybody in the back continues to speak, I will have you removed from the courtroom. If we have difficulties we that, I will have you incarcerated for contempt of court".


Shortly after the sentence was announced, a family member later identified as the defendant’s mother reacted with profanity. The judge ordered her taken into custody after she left the courtroom. Several minutes later after the judge issued sentences in other cases, the woman in custody for the outburst apologized to the judge.


"I'd like to apologize to you, for letting my emotions get the best of me, because I know better, and I respect the court. And, I want to apologize".


The judge said he didn’t take any pleasure in sentencing the woman’s daughter and opted not to rule her mother in contempt of court.


"Your apology is accepted. I appreciate it. I can tell you were sincere and you mean that...and you're not just saying that to get out of trouble".
The judge said the apology was a sufficient remedy to make sure it doesn’t happen again.


When Burr gets out of prison, she will serve 18 months post-release supervision.
