Appeals Court won't move murder case to juvenile court
NORTH PLATTE - A Grand Island teen will be charged and tried as an adult in North Platte.
KSNB Local 4 reports that Jesus Martinez faces life in prison in the death of Ethan Pohlmeier. The Nebraska Court of Appeals agrees this case doesn't belong in juvenile court.
Jesus Martinez is now 17, he was 16 when police say he shot Ethan Pohlmeier in North Platte during a drug deal in 2018. Martinez and Brayden Turner are both charged with first-degree felony murder and using a firearm during the felony.
A District Judge refused to move both of their cases to juvenile court and the Appeals Court agreed.
Nebraska sentencing laws say neither teen will face the death penalty if convicted. The firearms charge comes with a five to 50-year prison sentence.
